ACKNOWLEDGMENT, ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY

I understand and agree to the following:

1. Non-Medical Nature of Service
       The 3D/4D ultrasound provided by First Look Ultrasound, LLC, a Pennsylvania limited liability company (“First Look Ultrasound”), is elective and for entertainment purposes only. It is not medically necessary and does not replace or substitute for any medical or diagnostic ultrasound, including but not limited to screening for genetic disorders, fetal anomalies, fetal growth, or fetal well-being.
2. No Insurance Coverage / Payment Terms
       I understand that elective fetal portrait ultrasounds are not covered by any health insurance plan or flexible spending account. Full payment for my appointment is required prior to the session.
3. Ongoing Prenatal Care
       I represent and affirm that I am currently receiving prenatal care from a licensed medical provider. I acknowledge that First Look Ultrasound is relying upon this representation in agreeing to perform this elective ultrasound session.
4. Image Limitations and No Guarantees
       I understand that First Look Ultrasound cannot guarantee the quality, clarity, or accuracy of the 3D/4D images due to factors beyond its control, including but not limited to gestational age, fetal position, placental location, amniotic fluid levels, and maternal body composition. I further acknowledge that the images obtained are not true depictions of how my child will appear at birth and may differ significantly from images I have seen elsewhere.
5. Fetal Positioning and Rescheduling
       I understand that my baby may not be optimally positioned during my session (e.g., facing the spine), which may limit image quality. In such circumstances, First Look Ultrasound may, at its discretion, attempt to accommodate me or request that I return at a different time or date.
6. No Refund and Cancellation Policy
       All payments, deposits, packages, promotions, add-ons, and gift certificates are non-refundable and non-transferable. No refunds will be issued for missed appointments, late arrivals, early terminations, unsatisfactory images, or sessions that cannot be completed for any reason beyond our control.
7. Medical Concerns During Session
       If, in the sole judgment of First Look Ultrasound staff, an illness, injury, or condition arises that requires immediate medical attention, I consent to the immediate termination of the ultrasound session and understand that I will be referred to my treating physician.
8. Assumption of Risk
       I knowingly and voluntarily assume all risks, known and unknown, associated with the performance of this elective 3D/4D ultrasound session to myself and my baby. I acknowledge that keepsake fetal portrait ultrasounds are not medically necessary services.
9. Regulatory and Scientific Disclosures
       I understand that the U.S. Food and Drug Administration (FDA) and the American Institute of Ultrasound in Medicine (AIUM) discourage the use of medical ultrasound technology for entertainment purposes. While the FDA reports no currently known harmful bio-effects on the fetus, I acknowledge that future research may identify risks or adverse effects that are presently unknown.
10. No Diagnostic Review
        I expressly acknowledge that First Look Ultrasound will not review, interpret, or evaluate the ultrasound for diagnostic purposes and will not identify, comment on, or disclose any potential medical conditions, abnormalities, or concerns.
11. Release and Waiver of Liability
        To the fullest extent permitted by Pennsylvania law, I hereby release, waive, discharge, and hold harmless First Look Ultrasound, LLC, and its members, managers, officers, agents, representatives, employees, contractors, and insurers from any and all claims, demands, causes of action, injuries, or damages of any kind—whether arising from passive or active negligence or otherwise—related to the performance of the 3D/4D ultrasound session or any associated services.
12. Covenant Not to Sue
        I further agree that I will not initiate or pursue any legal action against First Look Ultrasound, LLC, or its members, managers, officers, agents, representatives, employees, contractors, or insurers for any claims arising from the ultrasound session or related services, including but not limited to the failure to identify or disclose any genetic disorders, fetal anomalies, defects, or matters related to fetal      health, safety, or viability.
13. Severability
        If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Governing Law and Venue
        This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Any legal action arising from this agreement shall be brought exclusively in a court of competent jurisdiction located within Pennsylvania.
15. Photo and Video Release
    I hereby grant First Look Ultrasound permission to use any ultrasound images, video recordings, photographs, or digital media obtained during my session for marketing, advertising, educational, and promotional purposes, including but not limited to social media, website content, printed materials, and online advertising.
